If our reportings reflect that we have received Net Sums that are payable to you at the next quarterly accounting period, then you may request an early payment to you of any or all such positive balance (an “Express Payment”). Songtrust shall make each such Express Payment to you in accordance with the relevant payment instructions provided in your Registration, less a five percent (5%) processing fee.
By requesting and receiving an Express Payment, you are acknowledging and agreeing that the royalty statement corresponding to such Express Payment is accurate and binding, and such royalty statement will not be subject to your objection for any reason. Following such Express Payment, the remaining Net Sums in your account (if any) shall be paid to you as otherwise provided for in this section. Notwithstanding the foregoing, Songtrust may suspend your ability to request Express Payments for any reason in its sole discretion. In the event that Songtrust has, in its reasonable business judgment, reason to suspect that your account has been subjected to and/or involved in fraudulent, infringing and/or illegal activities, in addition to any other remedy Songtrust may have pursuant to this agreement or otherwise, you acknowledge that Songtrust, in its sole discretion, may deem any early payment recoupable against any and all future payments of your share of Net Sums or may charge such amount to the credit card information you have authorized Songtrust to keep on file.
